How the Australian immigration system works in 2026

Australian immigration is governed by the Migration Act 1958 and the Migration Regulations 1994, with the Department of Home Affairs administering all visa decisions. The flagship route for Pakistani skilled workers is the General Skilled Migration (GSM) programme, which uses a points-tested invitation system called SkillSelect. You submit an Expression of Interest (EOI), the system ranks all candidates by points, and Home Affairs issues invitations to apply in monthly rounds. The published threshold is 65 points, but the effective cut-off for invitations to popular occupations is usually 80–90 points. Targeting the floor instead of the cut-off is the single most common reason Pakistani applicants sit in the EOI pool for 18 months without invitation.

Three Subclasses make up the core skilled programme: Subclass 189 (Skilled Independent) is fully points-tested with no sponsor — permanent residence on grant. Subclass 190 (Skilled Nominated) requires state nomination and a 2-year residence commitment to the nominating state; the state nomination adds 5 points to your score. Subclass 491 (Skilled Work Regional Provisional) requires state or family sponsorship for a regional area and grants 5 years of temporary residence, after which Subclass 191 converts it to PR if you meet the AUD 53,900 income threshold and 3-year regional residence rule. The Subclass 500 Student visa is the dominant study route, paired with the Subclass 485 Temporary Graduate visa that grants 2–4 years of post-study work rights depending on qualification level.

Skills assessment by the relevant occupation authority — ACS for ICT, Engineers Australia for engineering, VETASSESS for general professional, AHPRA for healthcare regulated professions, CPA Australia for accounting — is mandatory before you can submit an EOI. This is the most common bottleneck for Pakistani applicants because the assessment authority sometimes deducts years of work experience that were 'not closely related' to the nominated occupation. The Subclass 309/100 Partner visa pathway is the route most Pakistani de facto and married applicants take through an Australian citizen or PR spouse — offshore 309 grants temporary residence pending the 100 PR decision, usually a 2-year cycle. Citizenship requires 4 years of lawful residence including 12 months as a permanent resident, plus a citizenship test and the pledge ceremony.

The Australian Computer Society uses the Australian ICT major content benchmark to assess your degree and may deduct work experience years for any period before the date your qualification is considered 'closely related' to your nominated ANZSCO occupation. A BBA followed by ICT certifications often gets a 4–6 year deduction before assessable experience starts counting. The trade-off is the residence commitment: 190 ties you to the nominating state for 2 years, 491 ties you to regional Australia for 3 years before Subclass 191 PR.
