Spain rewrote its immigration rules in 2023. We file under the Startups Law.

The Startups Law (Ley 28/2022) that came into force in January 2023 gave Spain one of Europe's most modern immigration menus. A Digital Nomad Visa for remote workers earning above 200% of the Spanish minimum wage. The Spanish Golden Visa, however, was abolished in April 2025. If anyone in Pakistan offers you a Spanish property-based investor visa in 2026, they're selling you a route that doesn't exist anymore.

How the Spanish immigration system works in 2026

Spanish immigration is governed by Ley Orgánica 4/2000 and its 2011 regulation, with major reform via Ley 28/2022 (the Startups Law) in force from January 2023, plus the Reglamento de Extranjería overhaul through Royal Decree 1155/2024 that landed in 2025. There are two parallel processing tracks. The standard one runs through the local Oficina de Extranjería (Foreigner's Office) at the provincial level and takes 1 to 3 months. The fast track runs through the Unidad de Grandes Empresas y Colectivos Estratégicos (UGE) for Startups-Law categories and resolves in 20 working days with positive silence.

The UGE route is the lever Pakistani skilled applicants should pull whenever they qualify. Decisions on Highly Qualified Professional, Intra-Company Transfer, Digital Nomad Visa and Entrepreneur applications come in 20 working days. The silencio positivo doctrine means if the authority doesn't respond inside the window, the visa is deemed granted automatically. The HQP threshold sits at €40,000 for specialists and €56,520 for senior managers; the DNV requires roughly €2,762/month and at least 80% of income from non-Spanish clients. Both routes also unlock Beckham Law tax treatment.

Long-term residence (Residencia de larga duración) becomes available after 5 years of continuous legal residence. Pakistani applicants then need another 5 years (10 total) before they can apply for Spanish citizenship, which is the slowest naturalisation timeline in Europe except for Italy and Switzerland. Spain doesn't permit dual citizenship for Pakistani applicants on naturalisation, meaning you'd need to renounce Pakistani citizenship to take Spanish. This is a meaningful constraint that we factor into the long-term plan. Spain is excellent for residence and lifestyle; the path to a Spanish passport is long enough that most Pakistani clients use Spain as a comfortable long-term residence rather than a citizenship play.

Yes, but only on the UGE-processed routes under the Startups Law: Highly Qualified Professional (HQP), Intra-Company Transfer, Digital Nomad Visa, and Entrepreneur visa. The UGE (Unidad de Grandes Empresas y Colectivos Estratégicos) is a centralised unit in Madrid with a legal-positive-silence rule. If they don't respond in 20 working days, the application is deemed granted. Standard non-lucrative, student, and family reunion files still go through the local Oficina de Extranjería at the province level and take 1 to 3 months. The first thing I ask any Pakistani applicant targeting Spain is whether their profile fits a UGE route, because the time saving alone is worth the application work.

The Beckham Law (Régimen Especial para Trabajadores Desplazados) lets new tax residents pay a flat 24% on Spanish-source income up to €600,000 for six tax years, with foreign-source income largely exempt. You qualify if you have not been a Spanish tax resident in the previous 5 years, and you move to Spain to take up qualifying employment as an HQP, DNV holder, or company transferee. The savings on a €70,000 Spanish salary are substantial: about €6,000-€8,000 per year versus the standard progressive rate. No. The NLV explicitly forbids employment and self-employment inside Spain. You may continue to receive passive income from outside Spain: a pension, dividends from a Pakistani company, rental income from property in Karachi or Lahore, or interest on offshore savings. Many retired Pakistani military officers and civil servants use the NLV as a long-term residence vehicle, then transition to long-term residence at year 5 at which point employment rights kick in. The annual passive-income requirement is €2,400/month for the principal applicant, plus €600/month per dependant.

Yes, definitively. Spain abolished the Golden Visa (Visado por Inversión) in April 2025. Real-estate investment is no longer a route to Spanish residence. Existing Golden Visa holders keep their permits and may renew them under the old rules. If you're looking at investor migration to Europe in 2026, I now point Pakistani clients to Italy's Investor Visa (€250,000 into an innovative startup or €500,000 corporate), Greece's tiered Golden Visa (€500,000 in popular areas, €250,000 elsewhere), Portugal's investment-fund route (€500,000 fund subscription), or Malta. Anyone offering you a Spanish investor visa in 2026 is misinforming you.

For Pakistani citizens, the answer is 10 years of legal residence. Spain has a fast-track 2-year naturalisation rule, but only for citizens of Latin American countries, Andorra, the Philippines, Equatorial Guinea, and Portugal. Pakistan is not on that list. The 10-year clock also requires you to pass DELE A2 Spanish (a language exam) and the CCSE constitutional knowledge test before naturalisation. Spain doesn't permit dual citizenship with Pakistan on naturalisation, so you'd be expected to renounce. For most of our Pakistani clients, Spain is a comfortable long-term residence destination rather than a citizenship play.
